Can I obtain Legal Aid to pursue my claim?
No, since the 1st April 2000 Legal Aid ceased to be available to pursue claims for personal injury arising out of an accident. The Government wished to encourage the use of Conditional Fee Agreements so the claims would be funded on a no win no fee basis by the Claimant's solicitors. Your claim will usually also include a claim for what are known as special damages and that generally means that you can bring a claim for any out of pocket expenses or financial liabilities that you may have incurred directly resulting from the accident such as your insurance policy excess, loss of earnings, replacement vehicle hire charges, medical expenses, damaged clothing and other property items and depending on your vehicle insurance the cost of repairing or pre-accident value of your vehicle.
