| Can I obtain Legal Aid to pursue my claim? No since 1 st April 2000 Legal Aid ceased to be available to pursue most claims for personal injury. The Government wished to encourage the use of Conditional Fee Agreements so the claims would be funded on a "no win no fee" basis by the claimant's solicitors. Your claim will usually also include a claim for financial loss. That generally means that you can bring a claim for any out of pocket expenses or financial liabilities that you may have incurred, such as loss of earnings, medical expenses or extra care depending on the nature of your disease or injury and the nature and extent of the disability you may suffer. We also act for widows and widowers (an in certain circumstances their children) of those who have met their death as a result of disease or injury caused by the fault of their previous injury. Special considerations arise in these circumstances and these will be investigated with the client at our first interview.Back to Frequently Asked Questions |
