How can I fund my claim?
Initial advice given over the telephone is free. If Award Claims agree to take on your claim we will advise you on how the claim should be funded and that advice will be confirmed in writing.
You will only normally incur liability for legal costs if you attempt to pursue a fraudulent claim, fail to give proper instructions to the solicitors when they request you to do so or fail to accept their advice to settle or withdraw your claim.
There are several options that may be open to you to cover the funding of your claim, and the Award Claims solicitors will advise you how best to do this (as part of the initial free advice). For example:-
Pre-paid Legal Expense Insurance
You may find upon examination of your household insurance policy that you have the benefit of legal expenses cover and provided you have reasonable prospects of success that policy will provide funding for your claim. Award Claims will advise you further on this option.
You may also have rights to legal assistance from your Trade Union and we will advise in relation to this possible option.
No Win, No Fee
If you have the benefit of after the event insurance your legal expense insurers will provide you with an indemnity in respect of your personal liability for any costs which we are unable to recover on your behalf from the other party, together with any costs awarded in favour of your opponent, subject to the terms of your legal expense insurance policy. If it is possible to recover your legal costs from the other party, interest may be recoverable on those costs from the other side. We reserve the right to retain that interest as part of our recoverable fees.
If you do not have a pre-paid legal expense policy Award Claims will, under their "Award Scheme", agree to take on your claim act for you under a Conditional Fee Agreement (CFA). Under this agreement Award Claims will conduct your claim and will not seek costs from you should your claim fail or be withdrawn. If your claim is successful your costs and disbursements under the agreement will be recovered from the other side.
