No Win No Fee
No Win No Fee agreements are usually available*
for this type of claim. This means that you do not pay any legal
costs if you do not succeed in recovering damages or reaching a
settlement. Only if you win do you pay any legal costs and these
would come out of any damages or settlement achieved.
Unfairly Dismissed?
You will have been unfairly dismissed if the employer has dismissed
you without using a fair procedure or for an unfair reason e.g.
claiming you were guilty of gross misconduct when there was no evidence
to support such a finding. Unfair dismissal is one of the most common
types of claim that come before an employment tribunal.
In most cases compensation or re-instatement can be sought on your
behalf at the employment tribunal. The usual award sought by an applicant
to the employment tribunal is for compensation. The compensation limits
have recently been increased to a maximum of £60,100 (click
here for compensation limits).
Whilst unfair dismissal claims are the most common, other claims include
disability discrimination, race discrimination, sex discrimination,
redundancy and breach of contract.
Sex, Race or Disability Discrimination
There are no upper limits in relation to damages awarded for sex,
race or disability discrimination.

Compensation Limits
Basic awards are calculated using a formula which takes into account
your:
* Age
* Salary
* Length of service
Compensatory awards are based on your financial loss arising from
the dismissal. This will depend upon the time you are out of work,
and your salary or wage in your new job (in comparison to your old
job). You are under an obligation to mitigate any loss, ie. Minimise
your financial losses, therefore you should take steps to look for
work eg. Join employment agencies, visit your local Job Centre,
etc. It is important that you keep any records or correspondence
relating to your efforts to find alternative employment.
If you have been discriminated against you will also be entitled
to compensation for injury to feelings.
